Welcome to GoFuel. These Terms of Service ("Terms") govern your access to and use of the GoFuel mobile application and related services (collectively, the "Service") provided by JCobiq Energy Solutions ("GoFuel," "we," "us," or "our").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.
1. Eligibility
To use GoFuel, you must:
- Be at least 18 years of age
- Be a resident of Nigeria with a valid Nigerian phone number
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete registration information
- Not be prohibited from using the Service under Nigerian law
By using GoFuel, you represent and warrant that you meet these eligibility requirements.
2. Account Registration and Security
2.1 Account Creation
To access most features of the Service, you must create an account by providing:
- A valid Nigerian phone number
- Your full legal name
- A secure password
- Additional information as required for identity verification
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
We are not liable for any loss or damage arising from your failure to protect your account information.
2.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- You fail to repay credit obligations
- Your account shows suspicious activity
- We are required to do so by law
3. Wallet and Payment Services
3.1 Wallet Funding
- You can fund your GoFuel wallet using debit cards, bank transfers, or other payment methods we support
- All payments are processed securely through our payment partner, Paystack
- Wallet funds are not interest-bearing and are not NDIC-insured
- Minimum funding amount: ₦500
- Maximum wallet balance: ₦500,000
3.2 Wallet Withdrawals
- You may withdraw funds from your main wallet at any time (subject to verification)
- Withdrawal requests are processed within 1-3 business days
- We may charge a withdrawal fee (currently ₦50 per transaction)
- Locked savings plans cannot be withdrawn until maturity or with penalty fees
3.3 Transaction Fees
- Wallet funding: Free (payment processor fees may apply)
- Fuel requests: Free
- Wallet withdrawals: ₦50 per transaction
- Early savings plan withdrawal: 5% penalty fee
We reserve the right to modify fees with 30 days' notice.
4. Fuel Savings Plans
- You can create locked savings plans with specific goals and durations
- Savings plans can be manual or automated (with recurring deposits)
- Funds in locked savings plans cannot be used for fuel requests until withdrawn
- Early withdrawal of locked savings incurs a 5% penalty fee
- Automated savings require sufficient wallet balance; failed auto-deposits do not incur fees
5. Fuel Assist Credit
5.1 Credit Eligibility
To access Fuel Assist credit, you must:
- Complete BVN verification through our identity verification partner (Mono API)
- Have an active GoFuel account for at least 14 days
- Have completed at least 3 successful wallet-funded fuel transactions
- Have no outstanding overdue credit
- Pass our credit assessment based on your loyalty score and repayment history
5.2 Credit Terms
- Credit Limits: ₦5,000 - ₦100,000 (based on eligibility)
- Repayment Window: 7-14 days from disbursement
- Interest Rate: 0% (interest-free credit)
- Late Payment Fee: 5% of outstanding amount after due date, plus ₦500 per week
- Maximum Outstanding Credits: 2 active credits at a time
5.3 Repayment
- You can repay credit manually via Paystack or auto-debit from your wallet
- Partial repayments are allowed
- We will send payment reminders 3 days, 1 day, and on the due date
- Failure to repay on time will negatively impact your credit limit and loyalty score
- Persistent non-payment may result in account suspension and debt collection
5.4 Auto-Debit Authorization
By enabling auto-debit, you authorize us to automatically deduct credit repayments from your wallet balance on the due date. You can disable auto-debit at any time, but you remain responsible for manual repayment.
6. Fuel Requests and Vendor Verification
6.1 Requesting Fuel
- You can request fuel at partner stations shown on the map
- Requests must specify fuel type (petrol/diesel) and quantity (liters)
- Payment is deducted from your wallet or approved as credit
- You will receive a unique QR code and request code for vendor verification
- Fuel requests expire 24 hours after approval if not fulfilled
6.2 Vendor Fulfillment
- You must present your QR code or request code to the vendor for verification
- The vendor will scan/enter your code to confirm the transaction
- Once verified, the fuel will be dispensed
- If the vendor cannot fulfill your request, you will receive a full refund
6.3 Disputes
If you experience issues with a fuel request (wrong quantity, fuel not dispensed, etc.), you must report it within 24 hours via the app. We will investigate and resolve disputes within 7 business days.
7. Loyalty Score and Credit Limits
Your loyalty score is calculated based on:
- Number of successful transactions
- Credit repayment history (on-time vs. late payments)
- Wallet activity and savings behavior
- Account age and verification status
A higher loyalty score increases your credit limit and may unlock additional benefits. Late payments, failed transactions, and disputes negatively impact your score.
8. Identity Verification and BVN
- To access credit, you must verify your identity using your Bank Verification Number (BVN)
- We use Mono API to securely verify your BVN and perform identity checks
- By providing your BVN, you consent to identity verification and watchlist screening
- Your BVN is encrypted and stored securely; we do not share it with third parties except as required for verification
- Providing false or inaccurate information may result in account suspension
9. Location Services
- GoFuel uses your device location to show nearby partner stations
- Location access is required to use the map feature
- We only access your location when the app is active and with your permission
- You can disable location access in your device settings, but this will limit functionality
10. Push Notifications
- We send push notifications for transaction updates, payment reminders, and service alerts
- You can disable non-essential notifications in your device settings
- Critical transaction notifications (payment confirmations, security alerts) cannot be disabled
11. Prohibited Activities
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Provide false or misleading information
- Attempt to access another user's account
- Reverse engineer, decompile, or disassemble the app
- Use automated tools (bots, scrapers) to access the Service
- Engage in fraudulent transactions or credit abuse
- Harass, threaten, or abuse other users or vendors
- Interfere with the operation of the Service
- Violate any applicable laws or regulations
Violation of these prohibitions may result in immediate account termination and legal action.
12. Intellectual Property
All content, features, and functionality of the Service (including text, graphics, logos, icons, images, software) are the exclusive property of JCobiq Energy Solutions and are protected by Nigerian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not:
- Copy, modify, or distribute any part of the Service
- Use our trademarks or branding without written permission
- Create derivative works based on the Service
13. Disclaimers and Limitations of Liability
13.1 Service "As Is"
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
13.2 No Guarantee of Availability
We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- Partner stations will always have fuel available
- All fuel requests will be approved or fulfilled
- Your data will be completely secure from unauthorized access
13.3 Limitation of Liability
To the maximum extent permitted by law, JCobiq Energy Solutions shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from vendor actions or fuel quality issues
- Unauthorized access to your account due to your failure to secure credentials
Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to GoFuel in the 6 months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless JCobiq Energy Solutions, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your failure to repay credit obligations
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute with GoFuel, please contact us at support@gofuel.ng to attempt informal resolution before pursuing legal action.
15.2 Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Rivers State, Nigeria.
15.3 Arbitration
For disputes exceeding ₦500,000, you agree to resolve the dispute through binding arbitration in accordance with the Arbitration and Conciliation Act of Nigeria, rather than in court.
16. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms in the app with a new "Last Updated" date
- Sending a push notification or email
- Requiring you to accept the updated Terms before continuing to use the Service
Your continued use of GoFuel after changes become effective constitutes acceptance of the updated Terms.
17. Termination
17.1 Termination by You
You may terminate your account at any time by contacting us at support@gofuel.ng. You must repay all outstanding credit before termination.
17.2 Termination by Us
We may terminate or suspend your account immediately if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- You fail to repay credit obligations after 30 days past due
- We are required to do so by law or regulatory authorities
17.3 Effect of Termination
Upon termination:
- Your access to the Service will be revoked
- You must repay all outstanding credit immediately
- You may request withdrawal of remaining wallet funds (minus any outstanding debts)
- We may retain certain information as required by law
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoFuel regarding the Service.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
18.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor.
18.5 Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control (e.g., natural disasters, government actions, network outages).
